2. Information We Collect and How it is Used, and Purposes for Collecting of Information

2.1 This Site will never knowingly or intentionally collect any personal information about children under the age of 13. If the Site obtains actual knowledge that it has collected personal information about a child under the age of 13, that information will be immediately deleted from its database. Because it does not knowingly or intentionally collect such information, to the best of the Site’s knowledge and belief, the Site has no such information to use or to disclose to a third party. The Site has designed this Privacy Policy in order to comply with the Children’s Online Privacy Protection Act.

2.2 We collect the following information from you: (a) information you explicitly provide to us by completing any submission, registration, profile or account form(s) on or through this Site, including your name, email and mail addresses, and credit card information, and (b) information that is automatically collected by us when you visit this Site. We use this information for our own internal purposes, which are more fully explained below. We do not share your information with any other parties, unless it is necessary to do so in order to comply with state and federal laws, or to fulfill our obligations arising from this Site. For the purposes of this Privacy Policy, the term "other parties" shall not include any affiliate of MobileMatters, including, without limitation, its parent, subsidiaries, predecessors or successors in interest, assigns or any entity merged into or with MobileMatters (if any), and its authorized representatives and consultants who assist in supporting the Site.

2.3 If you subscribe to our mailings, email alerts or blogs, we ask for contact information (such as your name, email address and demographic information, if and when requested). We use this information in the same manner as we use your collected information during the account process and otherwise in this Site. Recipients of our mailings, email alerts and users of our blog can unsubscribe using the instructions indicated on this Site, or as stated in this Privacy Policy or otherwise.

3. Information You Explicitly Provide

Creating an Account. Visitors to this Site may be required to create an account with us by completing and submitting a short form on this Site which requires them to fill out certain information about themselves. Through this process, we collect your information (like your telephone number, credit card information and physical and/or e-mail addresses) and a user chosen password. The information we collect is used for our own internal tracking purposes - identification, service selection, evaluation and in support of this Site. We also use this contact information from time to time to send you mailings, email alerts and other materials about MobileMatters including information related to this Site and the content updates. We also retain certain portions of your contact information for our internal records. If you wish, at any time after creating an account with us you may ask us not to send you any further information about MobileMatters or this Site. See "How to Opt Out" below.

4. Information We Automatically Collect

IP Addresses. When you connect to the Internet, your computer has a unique identification code called a “MAC ADDRESS”. You also have an "IP address." Depending on the way you access the Internet, you may also have a different IP address each time you connect, or your IP address may be the same each time, or it may not be a unique IP address – you may share the IP address with others using your router. We log the IP addresses of users who visit this Site. We use your IP address for system administration purposes, such as to help diagnose problems with our server. In addition, we may use your IP address to help identify you and to gather broad demographic information about you and the rest of the users who visit this Site.

5. Disclosure and Use of Collected Information

5.1 Generally. We may provide aggregate information about visitors to this Site and our customers, sales, Site traffic patterns and related Site information to our affiliates, including without limitation our parent, subsidiaries, predecessors, successors and assigns or any entity merged into or with MobileMatters (if any).

5.2 Legally Compelled Disclosure of Information. We may disclose any and all information when legally compelled to do so, in other words, when we, in good faith, believe that the law requires it or if disclosure is necessary to protect our legal rights. We may also notify the appropriate authorities if we suspect that any of our users are engaged in illegal activities.

5.3 Use of Information. We use collected information for many purposes, including, but not limited to administering and improving this Site, diagnosing problems with our systems, developing new ideas and services, and communicating with you regarding future marketing and educational efforts (e.g., relevant industry events, MobileMatters co-sponsored events, educational programs, relevant industry information, and MobileMatters specific products). Generally, we do not share your personally identifiable information (including any information gathered through the account registration process such as name, email address) with other third party companies for their commercial or marketing use without your consent, other than to process any requests or other matters related to this Site. However, your personally identifying information (e.g., first and last name, title, email address, company name and address) may be provided to event sponsors for a one-time use only. We do share non-personally-identifiable information (such as anonymous user usage date, referring/exit pages and URLs, platform types, number of clicks, etc.) with interested third parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions and/or functionality on this Site. We do not compile, buy, sell, rent or trade consumer mailing lists.

If you do not wish to receive communication from a third-party sponsor of a MobileMatters event or other program, please send an email to info@mobileMatters.org (and mention that you have an opt-out request related to this Site), or write to us at the address below.

6. Our Security Measures

We take reasonab le security measures in order to protect the loss, misuse and alteration of the information we collect from you. If you wish, you may contact this Site’s Webmaster to find out more about the security measures we have implemented.

7. How to Correct Your Information

You have the ability to correct or change any information which you have previously provided to us by going to your account settings on the Site or by sending an email to info@mobileMatters.org. You may change this information at any time and as often as necessary.

8. How To Opt Out

You have the opportunity to opt out of receiving further communications from us at the time you register an account with this Site. Alternatively, if you initially decide to receive information from us but at a later date wish to remove your information from our database, you can do so by sending an email to info@mobileMatters.org (and mention that you have an opt-out request related to this Site).

9. What Are Cookies and How Do We Use Cookies?

9.1 "Cookies" are a feature of web browser software that allows web servers to recognize the computer used to access a Site. They are small pieces of data that are stored by a user's web browser on the user's hard drive. Information gathered through cookies and web server logs may include information such as the date and time of visits, the pages viewed, time spent at this Site, and the websites visited just before and just after this Site. Cookies can remember what information a user accesses on one web page to simplify subsequent interactions with this Site by the same user or to use the information to streamline the user's transactions on related web pages. This makes it easier for a user to move from web page to web page and to complete commercial transactions over the Internet. Cookies should make your online experience easier and more personalized.

9.2 We use Site browser software tools such as cookies and web server logs to gather information about this Site's users' browsing activities in order to constantly improve this Site and better serve our users of this Site. This information helps us to design and arrange our web pages in the most user-friendly manner and to continually improve this Site to better meet the needs of our users and prospective users. We do not use these technologies to capture your individual e-mail address or any personally identifying information about you.

9.3 If you have turned off all cookies, you may not be able to access any or all of the areas on this Site.

10. Linked Websites and Advertisers

10.1 This Site may contain links to other websites, as well as advertisements from companies or others with their own websites. We may also allow other companies, called third-party ad servers or ad networks, to serve advertisements within this Site. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on this Site. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content you see. We do not provide any personally identifiable information to these third-party ad servers or ad networks without your consent. However, please note that if an advertiser asks us to show an advertisement to a certain audience segment (for example, women ages 18-25 who have viewed certain channels of content) and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach. The advertiser may also use information regarding your use of this Site (but not any personally identifiable information), such as the number of times you viewed an ad, to determine which ads to deliver to you.

10.2 The websites and third party ad networks mentioned above may not have privacy policies, and we are not responsible for the privacy practices or the content of such websites or third party ad networks. If you have any questions about how these other websites or third party ad networks use your information, you should contact them directly.

11. Employees, Access, Training and Expectations

Our business values, ethical standards, policies and practices are committed to the protection of customer information. In general, our business practices limit employee access to confidential information and limit the use and disclosure of such information to authorized persons and processes.

12. Merger, Sale or Change in Control

In the event that MobileMatters is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from you as part of such merger, acquisition, sale, or other change of control.

13. Changes

In the future, we may make changes to this Privacy Policy. The revised Privacy Policy will be displayed via a link on this Site so that you will know what types of information we gather and the categories of other parties with whom we may share the information. Use of this Site constitutes acknowledgement and acceptance of this Privacy Policy and our right to modify such Privacy Policy without additional notice.
